Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") form a binding agreement between you ("you" or "User") and Niklas Funk, Jablonskistr. 12, 10405 Berlin, Germany, trading as "BiteReel" ("we", "us", or "our"). By accessing or using the BiteReel mobile application and related services (collectively the "Service"), you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

BiteReel lets you import short-form cooking videos from third-party platforms (e.g. TikTok, Instagram, YouTube), automatically extract structured recipe data with our AI, and store the results in a personal cookbook.

3. User Accounts

You must be at least 13 years old (or the minimum age required in your jurisdiction) to create an account. You are responsible for all activity that occurs under your credentials and for keeping your password secure.

4. Subscription Terms

4.1 Auto-Renewal

Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your Apple / Google account will be charged for renewal within 24 hours prior to period end.

4.2 Manage / Cancel

You can manage or cancel your subscription at any time in your device settings: Settings › Apple ID › Subscriptions (iOS) orPlay Store › Account › Payments & Subscriptions (Android).

4.3 Refunds

Payments are non-refundable except where required by law. EU consumers: see Section 14 for your statutory right of withdrawal.

4.4 End-User Licence

Unless you explicitly accept these custom Terms, Apple's Standard EULA applies by default.

5. Acceptable Use

When using the Service you agree NOT to:

• violate any applicable law or regulation;
• upload, import, share or store content that infringes intellectual-property rights or the terms of any third-party platform from which you import material;
• reverse-engineer, decompile, or otherwise attempt to access the source code of the Service or its AI models;
• use any robot, crawler, scraper or other automated means to access the Service without our prior written permission;
• upload viruses, malware or other malicious code;
• interfere with or disrupt the integrity or performance of the Service or the data contained therein;
• circumvent, disable or otherwise interfere with security-related features;
• collect or harvest personal data of other users without their consent; or
• use the Service to build a competing product or service.

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of all content you create or add to your account. You grant BiteReel a worldwide, non-exclusive, royalty-free licence to host, process and display your content solely to operate and improve the Service.

6.2 Third-Party Content

You are solely responsible for content imported from third-party platforms. You represent that you have the necessary rights to use such content. BiteReel does not claim any ownership of imported material.

6.3 Our Intellectual Property

The Service's code, design and trademarks are owned by Niklas Funk and protected by copyright and other laws. Except as expressly permitted, you may not copy or modify any part of the Service.

7. Privacy

Our collection and use of personal information is described in our Privacy Policy.

8. Disclaimers and Limitation of Liability

8.1 "AS IS" Service

The Service is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, to the fullest extent permitted by law.

8.2 Recipe Accuracy

BiteReel uses AI to extract recipe information. We do not guarantee the accuracy, completeness or safety of any recipe. You are responsible for verifying ingredients and instructions.

8.3 Limitation of Liability

To the extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Service.

9. Indemnification

You agree to indemnify and hold harmless Niklas Funk from any claim or demand, including reasonable attorneys' fees, arising out of your use of the Service or violation of these Terms.

10. Termination

We may suspend or terminate your access to the Service at any time for breach of these Terms. You may delete your account at any time via the in-app feature or by contacting us.

11. Governing Law and Dispute Resolution

These Terms are governed by German law. Mandatory consumer-protection rules of your home jurisdiction remain unaffected. If you are a consumer resident in the EU, you may bring proceedings in Germany or in the EU member-state where you live. Business users agree that the exclusive place of jurisdiction is Berlin.

12. General Provisions

• Entire Agreement — These Terms constitute the entire agreement between you and us and supersede any prior agreements.
• Severability — If any provision is found unenforceable, the remaining provisions will remain in full force.
• Changes — We may modify these Terms at any time. We will notify you of material changes. Continued use after changes constitutes acceptance.

14. Right of Withdrawal (Widerrufsrecht)

If you are a consumer resident in the European Economic Area, you have the right to withdraw from your Premium subscription within 14 days without giving any reason.

14.1 Withdrawal Period

The withdrawal period expires 14 days after the day of purchase.

14.2 Exercise

14.3 Early Performance & Waiver

By purchasing a Premium subscription and tapping "Buy", you request that we begin providing the digital content immediately and acknowledge that you lose your right of withdrawal once the download or streaming has begun.
